TERMS FOR SINGAPORE COMIC CON COMPETITION

By purchasing and owning a Nyammy Treats NFT, you are eligible to participate in a contest where you stand a chance to win an flight and accomodations paid trip to Singapore Comic Con 2022 (the “Contest”). To be eligible for the Contest, participants must own a Nyammy Treats NFT for the duration of the Contest period. The Contest is available to customers from any country. The Contest period, together with the further mechanics for the Contest, shall be announced at a later date. In the meantime, the following general terms for the Contest shall apply:

1. This Contest is organised by Mighty Jaxx International Pte Ltd (the “Organiser”, “us”, “we”, or “our”).
2. By signing up for the Contest, you agree that these rules shall be binding on you, and that your entries in the Contest, including your name and likeness, may be used without restriction in any future publicity material by us.
3. We reserve the right to amend these rules or terminate the Contest at any time at our sole and absolute discretion and without further notice to you. All decisions made by the Organiser under these rules shall be final and no discussion or correspondence will be entertained.
4. We reserve the right to disqualify you from the Contest, or to withdraw any prize or part thereof if it believes you are in breach of your obligations under these rules.
5. All entries are submitted to the Organiser at your own risk, and in the event that there are any technical difficulties arising from use of the Internet or from any associated equipment or if internet security is compromised, we may at our sole and absolute discretion disqualify the entire entry and shall accept no liability for doing so.
6. Contest entries may only be submitted in the manner provided for in our Contest promotional materials.
7. This Contest is only open to persons above 18 years of age. Submissions from any persons below 18 years of age will be automatically disqualified. The Contest is open to customers from any country.
8. Entries will be judged by the Organiser, and our decision will be final.
9. Prizes for this Contest are neither exchangeable for cash nor transferable. The Organiser reserves the right to substitute the prize with a gift of equal or greater value at its sole and absolute discretion.
10. The Organiser shall not be responsible for any additional costs and/or expenses in relation to the prize, including any personal expenses, other than any specifically listed as part of the prize.
11. Upon request, the Contest winner may be required to produce his or her identity documents， wallet address, and other proof of ownership of the NFT in order to claim the prize. The winner will be responsible for ensuring the validity of his or her visa, passport, and other relevant travel documents, and will be further responsible for ensuring that they comply with all applicable immigration and other laws.
12. All prizes are accepted entirely at the risk of the winner, and the Organiser excludes all warranties and liability in connection with the prize, to the fullest extent permitted by law.
13. All contestants shall release from, and indemnify the Organiser, its affiliates, officers, directors, and employees against all liabilities, costs, losses or expenses arising out of acceptance of any prize or participation in the Contest, including (but not limited to) any personally injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
14. All personal particulars furnished are meant for identification purposes only and will not be sold or transferred to any third parties.

TERMS FOR WHITELISTING FOR FUTURE PRODUCTS

By purchasing and owning a Nyammy Treats NFT, you may be whitelisted to obtain early access pre-orders to a future range of products (the “Products”) launched by Mighty Jaxx International Pte Ltd (“Mighty Jaxx”). These terms, in addition to the Mighty Jaxx Terms of Service, NFT Terms and Conditions, and Privacy Policy (the “Mighty Jaxx Terms and Conditions”), govern your access to the Products:

1. Mighty Jaxx may in the future invite you to place pre-orders for the Products, and you may accept or decline such invitation at your sole discretion.
2. Your access to such pre-orders may be subject to availability and additional terms which will be communicated to you.
3. Mighty Jaxx may discontinue your whitelisting, early access, or the pre-order process at any time in its sole discretion, and may never make them generally available. To the fullest extent permitted by law, Mighty Jaxx will have no liability for any loss or damage suffered arising out of or in connection with such whitelisting or early access.
4. Should you choose to place a pre-order on the Product(s), you agree to be bound by our general terms of sale and the Mighty Jaxx Terms and Conditions.

TERMS FOR F&B REDEMPTION AT THAILAND TOY EXPO 2022

The following terms shall be applicable to Purchasers who hold an NFT purchased at Thailand toy Expo 2022 (the “Event”).

1. Each NFT shall entitle its Purchaser to redeem a complimentary on-location food item (the “F&B Redemption”) at the Event from 28 April 2022 to 1 May 2022.
2. To redeem an F&B Redemption, you will need to:
   1. Hold the NFT at the time of such redemption. For the avoidance of doubt, if you sell or otherwise transfer your NFT prior to such redemption, You will not be able to claim your F&B Redemption, as the right to such redemption is always transferred along with the NFT.
   2. Be at least 18 years of age.
   3. Visit the Mighty Jaxx booth at the Event, where you may select the F&B Redemption you wish to redeem in accordance with our on-site instructions.
3. Each Purchaser is strictly entitled to redeem only one F&B Redemption per NFT.
4. The F&B Redemption will be free for You to redeem, subject to the restrictions in these terms and conditions.
5. Your ability to redeem an F&B Redemption is subject to availability, and we cannot guarantee the availability or otherwise of any F&B Redemption.
6. Mighty Jaxx may, upon request, require all Purchasers to present valid identification for verification of the Purchasers’ identity and proof of purchase of the NFT.
7. You will not be entitled to a refund of any kind if you sell, transfer or otherwise lose access to, including by theft or hack, the NFT prior to your F&B Redemption at the Event.
8. We reserve the right to refuse to deliver any F&B Redemption in any situation, or to exclude any person from participating in the redemption, without providing any prior notice and/or reasons, and in our sole and absolute discretion.
9. The right to any F&B Redemptions cannot be severed from ownership of an NFT, and may not be exchanged for cash.
10. Mighty Jaxx reserves the right to amend, in its sole and absolute discretion, the mechanics and/or details of any F&B Redemption or other Redemption Benefits, without providing prior notice to Purchasers.
11. By participating in the F&B Redemption, You agree that Mighty Jaxx has the right to video, photograph and/or record the redemption activities, and publish Your images and details for any purpose related to the redemption (including for marketing and promotional activities), without having to provide any compensation to You.
12. Purchasers who have been found to have engaged in any misconduct, including cheating, fraud and/or manipulation shall be disqualified from the F&B Redemption.
13. Our decisions on all matters relating to the F&B Redemption shall be final, and we will not entertain any correspondence or appeals on the same.
14. In the event of any inconsistencies between these Terms and the contents of any promotional material relating to the redemption, these Terms shall prevail.
